Yes, I think the penalty should be the same if you are in a non-injury accident than if someone dies. The intent was the same. If it is a simple accident, no one is charged whether someone dies or not. If you are drunk and get into an accident, it should be attempted manslaughter. If you are rolling drunk and just driving along on your merry way and get pulled over, attempted manslaughter again. The punishment in these situations should be the same because the intent was the same. So - if someone had walked out in front of this officer with no warning and there was no way to avoid them, you honestly think they should have a worse punishment? Seriously? Would his actions have changed any in either instance? No.
