I never once said speed was the only factor, just that it was the only factor that DEFINITELY would have avoided this incident.

You didnt turn anything on me, you simply avoided the points made, and threw in a bunch of unrelated random thoughts, that do not pertain to the argument.

There is no elephant in the room, as I have never once said anything in support of her for driving drunk, ONLY that in and of itself, does not prove anything as to her 'fault' based upon her obvious ability to have gotten that far.

According to your interpretation of the law, if my car is in $hitty shape, and I see someone obviously drunk, drive off in a Mercedes, I can intentionally run into them, and they would be at fault because they were drunk. I get a free car...nice!

Also, is doubling the speed limit, not also a felony?
