I hope whoever held this graduation party has good homeowners insurance as they will most certainly get sued by the officer for allowing this adult to get drunk at their place then drive away endangering our entire community and herself. While the excessive speeding was very wrong she was ultimately responsible for driving while very intoxicated and turning into the path of traffic that had the right of way that can be seen coming for at least a 1/2 mile speeding or not. There is no way to prove that the speed of his vehilce caused her death or if she would have died if he had been going below the speed limit. As stated, the officer even tried to take evasive action by speeding up to go around her after she pulled in front of him while he had the right of way. So his speed at the time of impact increased due to having to take evasive action to avoid a drunk driver that turned in front f him. While this is a tragedy for both involved, this is only a big story because he is the Police. I hope that he and Metro use every legal avenue to protect themselves and their assets. Including suing the party host and the families vehicle insurance company. In the end the deceased was DRUNK.

So if the parents are suing anyone that could possibly have anything to do with the death of their daughter - they themselves should top the list! "Here, drink this." Sue yourselves. Then sue the brake manufacturers, whoever put in the stop sign or traffic light, whoever designed the roadway, poured the asphalt, who ever made the 'easy-to-use' glass she drank from. It goes on and on.

Metro will pay somewhere between 300-500 grand. Parents will take it even though they are wrong 'cause they know they will lose in the end. Lawyers make out like bandits and get 40% for MAKING them push the issue.

The investigation revealed the officer was driving over 80mph in a 45 mph zone so it's likely they will win the case. Kentucky's law is explained below. The moral of the story is don't speed excessively. He would have been fired and indicted in many jurisdictions. Louisville's prosecutors are fairly lax as you know.

Presently, thirteen (13) states follow a pure comparative negligence system: Alaska, Arizona, California, Florida, Kentucky, Louisiana, Mississippi, Missouri, New Mexico, New York, Rhode Island, South Dakota, and Washington. In a pure comparative negligence system, a judge or jury assigns a percentage of fault to each responsible party and then apportions the damage award accordingly. Using this system, an injured person may recover his or her damages even if the injured person was 99% at fault in causing the injury, with those damages reduced by his or her portion of the fault. For example, in a car accident between Dave and Debbie where Debbie was found to be 99% responsible, and the jury found that Debbie suffered $10,000 in damages, that award would be reduced by Debbie's 99% fault in causing the injury. In the end, Dave would only have to pay 1% of Debbie's damages, or $100 in this case.

It was an accident. The black box showed an acceleration rate that was increasing for him to try to go around her. Point of impact was 56 miles per hour. He realized that he was going to hit her no matter what and hit the brakes - also on the black box. This should have never even gone to the grand jury. Her family is a pathetic piece of sh...t for suing when they let her drive drunk in their vehicle. She wentby her boyfriends after the party and they were headed out to drink MORE at Molly Malinda when she changed

I'm very sorry to this officer and the rest of the department for being dragged through the mud because a stupid little girl got drunk and turned in front of his car.

He could have easily been killed and she could have walked away... and the shame about it is that the people in this backwards town would probably have stilled blamed the officer. It's a sad fact that you guys can't win... the people vilify you for every little thing you do, yet they don't hesitate to call 911 when their butts need help for getting themselves in stupid situations.

I'm thankful to each and every one of you for every shift you take. I'm thankful that I know I've got you watching my back. I'm thankful, and humble, that you put your lives on the line for me every single day.

I had to reply to all the posters putting the blame on that girl. Speed played some part in that wreck, just like the alcohol. But when people start out with "If her parents only cared" and other cruel sentences, it runs all over me. And I understand the grand jury returned a "no true bill" against the officer, so be it. Can't some of you people be a little more considerate when writing about a precious young life that was taken too soon. Also, I don't even know what a troll is.

Well to argue your points:

1. If she had not driven, because she was DRUNK, then then the accident would NOT have happened.

If her family or friends had taken her keys, because she was DRUNK, again the accident would not have

happened. (DEFINITELY)

2. Since her "best friend in the whole world" has even been on this forum stating that she was texting... Then I

guess that proves the argument. SO if she had not been texting while driving DRUNK the argument would not

have happened. (DEFINITELY)

3. Since she was DRUNK, and was struck after turning illegally infront of another car, then the argument is IF SHE HADN'T done that while drunk, the accident would not have happened.

Maybe if the previous 7 to 10 times she had been charged for speeding and inappropriate driving (per the communist journal) she had her license taken from her by the court, then she would be alive and the other driver wouldn't have had to deal with the trauma of the scenario.

If you weren't such an angry little troll, then maybe I would feed you less. But darn, it is fun to take your arguments and through them to the wind with REALITY.

Common Cognitive ProcessesNot only can personality traits of DUI offenders be dissimilar from the rest of the population, but so can their thought processes, or cognitive processes. They are very unique in that "they often drink despite the severity of legal and financial sanctions imposed on them by society."[2] In additional to these societal restraints, DUI offenders ignore their own personal experience, including both social and physical consequences. The study "Cognitive Predictors of Alcohol Involvement and Alcohol consumption-Related Consequences in a Sample of Drunk-Driving Offenders" was performed in Albuquerque, New Mexico on the cognitive, or mental, factors of DUI offenders. Characteristics such as gender, marital status, and age of these DWI offenders were similar to those in other populations. Approximately 25% of female and 21% of male offenders had received "a lifetime diagnosis of alcohol abuse" and 62% of females and 70% of males "received a diagnosis of alcohol dependence." [2] All of the offenders had at least one DWI and males were more likely to have multiple citations. In terms of drinking patterns approximately 25% stated that "they had drunk alcohol with in the past day, while an additional 32% indicated they had drunk within the past week."[2] In regards to domestic drinking, "25% of the sample drank at least once per week in their own homes." [2] Different items were tested to see if they played a role in the decision to drink alcohol, which includes socializing, the expectation that drinking is enjoyable, financial resources to purchase alcohol, and liberation from stress at the work place. The study also focused on two main areas, "intrapersonal cues", or internal cues, that are reactions "to internal psychological or physical events" and "interpersonal cues" that result from "social influences in drinking situations."[2] The two largest factors between tested areas were damaging alcohol use and its correlation to "drinking urges/triggers."[2] Once again different behaviors are characteristic of male and female. Males are "more likely to abuse alcohol, be arrested for DWI offenses, and report more adverse alcohol-related consequences." However, effects of alcohol on females vary because the female metabolism processes alcohol significantly when compared to males, which increases their chances for intoxication.[2] The largest indicator for drinking was situational cues which comprised "indicators tapping psychological (e.g., letting oneself down, having an argument with a friend, and getting angry at something), social (e.g., relaxing and having a good time), and somatic cues (e.g., how good it tasted, passing by a liquor store, and heightened sexual enjoyment)."[2] It may be that internal forces are more likely to drive DWI offenders to drink than external, which is indicated by the fact that the brain and body play a greater role than social influences. Another cognitive factor may be that of using alcohol to cope with problems. It is becoming increasingly apparently that the DWI offenders do not use proper coping mechanisms and thus turn to alcohol for the answer. Examples of such issues "include fights, arguments, and problems with people at work, all of which imply a need for adaptive coping strategies to help the high-risk drinker to offset pressures or demands." [2] DWI offenders would typically prefer to turn to alcohol than more healthy coping mechanisms and alcohol can cause more anger which can result in a vicious circle of drinking more alcohol to deal with alcohol related issues. This is a not the way professionals tell people how to best deal with the struggles of everyday life and calls for "the need to develop internal control and self-regulatory mechanisms that attenuate stress, mollify the influence of relapse-based cues, and dampen urges to drink as part of therapeutic interventions."[2]

Perceived Recovery RateAnother factor which may also contribute to people driving under the influence of alcohol aside from their mental state, personality, or background, is the direct effect of alcohol on their brains. A study, discussed in the article "Why drunk drivers may get behind the wheel", was done with college students in which the students were tested with "a hidden maze learning task as their BAC [Blood Alcohol Content] both rose and fell over an 8-hour period."[3] The researchers found through the study that as the students became more drunk there was increase in their mistakes "and the recovery of the underlying cognitive impairments that lead to these errors is slower, and more closely tied to the actual blood alcohol concentration, than the more rapid reduction in participants' subjective feeling of drunkenness."[3] The participants believed that they were recovering from the adverse effects of alcohol much more quickly than they actually were. This feeling of perceived recovery is a plausible explanation of why so many people feel that they are able to safely operate a motor vehicle when they are not yet fully recovered from the alcohol they have consumed, indicating that the recovery rates do not coincide. This thought process and brain function that is lost under the influence of alcohol is a very key element in regards to being able to drive safely, including "making judgments in terms of traveling through intersections or changing lanes when driving."[3] These essential driving skills are lost while a person is under the influence of alcohol.

I'd like to address the point you seem to keep going back to and getting yourself all in a tizzy over. The one about how the accident DEFINITELY wouldn't have happened had the officer not been speeding.

Just for sh!ts and giggles, let's say he was driving 85mph. Sober. Not on the phone. Both hands on the wheel at the 10 and 2 positions. And Sarah had stopped to argue for a moment with her parents about the logic of getting behind the wheel while impaired by alcohol. So she's been delayed for a second while flipping the bird at her parents for being concerned for her well-being and safety.

OH MY GOD... THE ACCIDENT WOULDN'T HAVE HAPPENED!! He would have been long gone before she made her left turn.

Oh, wait... oops. Instead of the officer, it was a car carrying a young family that was traveling the speed limit and she pulled in front of them. Shame about that pregnant mom in the passenger seat that died, isn't it?

Or... perhaps if the officer wasn't speeding, and she had still stopped to flip off her parents, or stopped at a red light, or been driving a little bit faster because she was paying attention instead of texting, yes, the accident still would have happened.

The only way the accident wouldn't have happened is if NEITHER of them had been on the road driving that night.

So, you see, your point is invalid. A variety of really crappy things happened. Speeding a factor, yes. Texting a factor, yes. Being upset, yes. Being drunk, yes.

There is no way you can say the accident wouldn't have happened if he'd not been speeding. Because... and this brings me to your next argument... sober people, unless they have some sort of genetic deficiency, can judge the speed of cars coming towards them and NOT pull in front of speeding vehicles.

As a sober person, I really have to say bullsh!t on you and your friends. I can judge the speed of cars coming at me. If you, or your friends, cannot, and get nailed turning in front of speeding vehicles... Well, Darwin's Law is in full-effect there. You, and your friends, are polluting the gene pool and need to be removed.

I mean, it seems that you're an atheist... I'm agnostic, by the way... so that leads me to think that you believe in Darwin's Theory of Evolution. The weak get eaten by the strong. People who are too stupid to realize a fast car is moving towards them and don't stop get removed from the game. People who are too stupid to realize that driving drunk is dangerous get removed from the game.

If I had to choose between living in a world full of people driving 85mph and a world full of people driving drunk... I'll take the speeders any day of the week and twice on Sundays.
