Have you read the actual police reports or seen the actual interviews? Have you listened to the officer's side of the story? As a police officer, you should have the mental capacity to realize that you can't make a determination of what actually happened without all the facts. James Adams is a very good officer, a very good person, and has a reputation for being highly trustworthy. If he said something happened in a certain way in the interviews, then I believe that it was his perception of what truly happened. Good God - leave him alone. Do you not think he and his family have been through enough over an accident - one moment in time in an entire lifetime. It is really time that everyone shut up and move on.

Now that you quote civil law, let me remind you that the jury may very well find Ms. Bearden to be mostly at fault for this accident. My opinion is that the city will settle on this before it goes to trial.

I thought the disgruntled county cop's post was very intelligent and thought provoking (26 yrs on). Many valid points. The whole thing s.u.c.k.s eggs though. Jimmy is a good cop, and he doesn't lie. I have worked with him too. If he said, "This is how it happened," then I believe him. It doesn't matter what the truth is though. Jimmy will get screwed. Ms Bearden will still be dead (yes, I feel bad for her and her family too, even if they are doing the wrong thing by suing). The department will cave and give away hundreds of thousands of taxpayer dollars. The liberal media will report how evil cops are and claim a victory for the oppressed citizens of Louisville to the tune of half a million dollars. If you will excuse me, I'm gonna order some hot coffee from McDonalds now. Oh, and my badge doesn't start with a 6, 7, or 8.

Do an open records request for the actual black box data. The facts are straight off the black box.

No one said he sped up from 45. The officer said that he didn't know the speed limit in that area and figured it was probably 55 when asked.

Bottom line, if I got caught going that fast (and witnesses pegged him driving fast and reckless before the wreck) I'd be in jail that night - even if the wreck had NOT occurred. I'm not excusing her intoxication, but as another poster said, speed killed her, not intoxication. There is an argument that if he'd been going somewhere close to the speed limit she would have had plenty of time to turn - but for his speed she'd have been dead. The question will be for the jury (if it goes that far) - and will be the jury thinking, would I have turned? If they do some good experiments, and if I was representing the family I'd be out there doing them, they will at least be able to make the jury think, would I have turned?
