You are correct that Assault 4th does not mandate an arrest per KRS, but per the LMPD policy it does. It is one of the few you can arrest for without seeing it in person. Yes the LMPD policey is more restrictive than the KRS. The other thing to keep in mind is the KRS states you (as a Police Officer) will do everything you can to prevent further violence from occuring. Now an arrest is the easiest way to do this because if you leave the offender at the residence and they further assault or kill the victim YOU WILL BE BROUGHT UP IN COURT AS LIABLE for not doing everything you could to prevent it and for not following SOP from LMPD.
