It's a common misconception that domestic violence (assault 4th) requires an arrest, it does not. (Violating an EPO/DVO, however, is a mandatory, provided you have probable cause - which is required for every arrest, of course.) And of course, there are a lot of actions that are called domestic violence that you can't arrest for at all, only the assault 4th is a permissable arrest. And ... there are lots of incidents that are dispatched as domestic violence that aren't at all.
