David James can't serve as Metro Council member and UofL police officer, County Attorney says |
RE: David James can't serve as Metro Council member and UofL...
the law isn't clear. other "sworn" university officials have held elected positions. the law was meant to prevent a city or county employee from being in a position to give him or herself benefits, pay raises, and such. It was not meant to prevent a person from being a police officer or firefighter in one jurisdiction from being involved in politics in another area or jurisdiction. As others have posted, it's a dumb law that was designed to keep Kentucky run by the same folks who have been running the state since after the Civil War.

The statute says nothing about "sworn" - it does not just apply to law enforcement officers. Years ago, there was a paramedic who wanted to work for one of the local PDs, can't remember which one, a municipal position, and also for a public service EMS agency in another county, part-time, he was told he couldn't because it would be two municipal positions. I agree about the hours though.
