Had a DUI go to a bench trial. Myself and another officer testified about all the good stuff - guy parked his car, got out, stumbled into where we were working off duty. Only person in car, witnessed him driving, etc. Went to a bench trial, judge acquitted him because we didn't recall which direction he was traveling on the road before he pulled into the parking lot.

Don't get all preachy about statutes....else, we can start talking about Robbery 2nd's that get pleaded to TBUT's, Assault 3rd that get amended to Assault 4th or even dismissed, because it's our job to get hit. Hell, the elements for assault 3rd include "attempting to cause" physical injury. Try getting that charge to stick, when a guy swings and misses. It meets the elements, but will get dismissed every time.
