Well, I came form one of those smaller Dept.s out in the state. I can say this. I had cases of POM and the amount involved was very minimal. "A pinch between you fingers" and get a conviction and jail time served.

I have made arrests here in Louisville involving ALOT more weed than that and the responses I get from the prosecutors are "it's just a little weed" and my favorite " if we go in ther with only enough weed to fill a baggie they are going to laugh at us".

I thought the same thing when I came here. These guys just need to document better. Then I recieved my lesson. If anything you have to document better here.

You get the judges and prosecutors you elect. It's a dual problem. If judges hand down bad rulings, and the prosecutor refuses to appeal it, then they are both part of the problem. How about endorsing, horror of horrors, the REPUBLICAN candidate for once? Get some new blood in the prosecutors office and have them start appealing some of these District Ct decisions that are clearly against state case law, and the judges will take notice. It is the prosecutor's job to bring relevant case law to the judge, and if the judge rules against that case law, to appeal it. Lots of mistakes get corrected at the Court of Appeals level.
