So, why isn't the County Attorney appealing those cases? The District Court level is not the end of the line, after all. Let them get overturned a few times and then use it against 'em in the next election.

If you as an officer want your case to stand the test of court, then you need to document the facts on your citation as they are in the KRS. list your PC and the facts for the arrest and don't give inorder to just get out of court and you will have no problem. Its difficult to press your case when the citation does not contain the proper information as listed in the KRS. If needed you can write a narative as long as is needed to include another citation as page 2.

Well, if you would read the actual law on that matter, it says that the subject has to be in physical control of the motor vehicle. Does not stipulate that they have to be driving. If you are going to argue a case, know the rules behind it. I have won DUI cases based on a guy passed out behind the wheel with the keys in the ignition and car off. He had physical control! The law is the law, know it and use it.
