The incentive money isn't guaranteed to them by law - it is up to the local government whether they accept it or not. Louisville simply decided not to accept it for the firefighters, although I assume they still accept it for the police. The Mayor could, of course, decide not to take it for the LMPD, as well. (I don't think Corrections gets it, though.) The lawsuit judgement is theirs, but they have to calculate it - and fire doesn't seem to be pushing that issue. (I know it is complicated to do, but sometimes, you just have to do it and get it over with. In addition to figuring out what they owe the firefighters, they also have to figure out how much they owe the pension system.) However, Louisville taxpayers still have no choice but to pay into it, so once again, Louisville taxpayers are paying for things for which they (or their responders, in this case) get no benefit.
