This is the only jurisdiction in Kentucky where shooters aren't routinely charged and tried for both attempted murder and assault 1st. If they're convicted of both, then the prosecutor is who ordinarily moves to dismiss the Assault 1st charge. It's not the job of police to downgrade charges, but to charge where there is probable cause to believe the offense was committed.

Attempted murder isn't exactly the same set of elements as assault 1st either. You can attempt to murder someone without carrying out an assault 1st.

The biggest difference between Jefferson County and other counties is how serious felony charges are regularly pled down to almost nothing, how few defendants are charged as persisted felony offenders, how low bail is for serious violent crimes, and how the sheriff, corrections and police neglect to locate all of the felons violating terms of their bonds, parole, and probation. People surprised at the number of shootings shouldn't be. The murders are the inevitable result of the Jefferson County justice system's irresponsibility and negligence, made worse by the state's "prison reform" bills setting felons free and LMPD laying down since Conrad took over.
