If the officer does not have any reason to believe that person has committed any other crime, then he has no right to disarm that person.

This all gets worked out in civil court. On each and every case….one by one. You see, we all have constitutional rights and rights given to us by state law. One of those rights is to openly carry a weapon. If you are detained or arrested for doing such, then you must sue in civil court for a violation of your civil rights. However, if you break the law while standing up for your civil rights, you may be arrested and convicted. For example, if you are falsely arrested and resist that arrest, then you can be convicted of resisting arrest. One is not permitted by law to resist arrest, even if the arrest is unlawful. The remedy for being falsely arrested is to sue in civil court.

The attention seekers need to get over the REAL reason they openly carry, grow up, and protect themselves and their families by carrying concealed. Why would you want to let someone know you are carrying? You just lost the element of surprise. I don’t get it.

The police need to realize open carry is legal and learn to deal with it.

Fewer egos on both sides and this issue is solved.
