I'd like to see what you do in pitch black when you are being robbed by at least TWO people and they are reaching for YOUR gun and it DISCHARGES. In a split second when you react to the perpetrators (after you are on the ground, it's pitch dark out, your own guns goes off and you think YOU have been shot). You're telling me that you wouldn't fire to save your own life????? C'MON!!!!!!! You'd still be complaining if he was shot in the chest! I'm not saying that someone's back is a fair target either, because it isn't and we aren't trained that way. BUT... you can't always see a moving target's FACE when it's dark out to know. ALSO read KRS statute 503.090 Use of Deadly Force. It says a police officer is justified to shoot a fleeing suspect (Newby) who he has just witnessed committing a felony (robbery) and believes that if not stopped he is likely to endanger the welfare of another person (Has a .45 caliber weapon and crack vials in his pocket and JUST TRIED TO KILL A POLICE OFFICER).
