They would have never won that case in a trial. You cannot "wantonly endanger" somebody with a fake gun. You might get a menacing but if I point a plastic gun at you and pull the trigger, you cannot say you I showed extreme indifference to the value of human life. Just saying...

Where is the risk of death or serious physical injury to the victim? Where is the wanton conduct on the part of the perp? Your statement of ""There is a highly probability of someone losing their life or getting seriously injured when they point a gun, real or fake, at a police officer"" is justification if the Officer had fired his weapon not the basis for a criminal charge. You can't be guilty of WE 1st on yourself
