Whitlock took it upon himself to patrol Walmart. Look at his citations, many of them come from that location; he wouldn't allow LMPD to do thier job. He was contracted by a third party security company in 2010 for one single job. Walmart has already washed their hands of him saying they don't contract him and he was doing this on his own. Fact of the matter is that loss prevention would allow Whitlock to "play" with them. They called him on his cell phone, I know Whitlock would knock on the loss prevention door and let them know he was in the store or talk to the employees and announce his presence.

Remember, there is no on duty/off duty concept for him, he IS the constable 24/7 and everything he does he does as the constable. He carries a 10K bond (check the Metro Council website, there is an ordinance each time he rebonds) which won't begin to cover the damages. He can expect the county attorney to represent him. This is why it has been so stupid - they have all simply been ignoring the "elephant in the living room" and you know what the elephant will eventually do - what he just do. This was really best case in a lot of ways, he didn't kill someone, he didn't get himself killed and he didn't get any other officer involved in one of his messes. He's on the hook for this one. I don't see any liability on the part of Wal-mart, though, they called a peace officer. (Don't like it, but he is.) I do think this is going to focus a lot of attention on his illegal deputies, though, including apparently ODPS, which has been using them? That is where he needs to be nailed, not for the shooting, but for his conspiracy to commit multiple felonies, one for each of the deputies he's caused to be impersonating a peace officer. I'd LOVE to see them all arrested and watch them all start turning on him like rats will do when trapped.

There are a lot of other issues with him that are just now bubbling to the service. For example, if all these vehicles, etc. are in the name of the Constable's Office, how were they paid for? And better yet, when he is no longer the constable, then what? Who owns them? And is he reporting all this income to the IRS and the state? I bet not, he's likely buying all these cars and writing them off as expenses. And how much IS he getting paid by Louisville Metro? I keep hearing 100 a month, but if that is the case, what about the statute that says he gets 9600 a year PLUS 200 a month as a car allowance?
