Actually, that is a myth, you can arrest him, but only if he breaks the law. (That's just an old law enforcement myth, not based in law at all.) Problem is, PIU has consistently ignored the one area where he is blatantly breaking the law - by swearing in deputy constables. He does NOT have the required permission to do so from Fischer, as required under KRS 70.320. But NO ONE will take action against him. At one point, he even swore in a convicted felon.
