I knew something like this would happen eventually. Southy's have had to deal with this nuisance for years. The really bad thing is that he drives around an un-marked suburban with, YES, blue lights. The common citizen thinks he is LMPD, which makes us all look like goof balls.

The Department of Criminal Justice Training (http://docjt.jus.state.ky.us/) in Richmond, Kentucky report Constable David Whitlock failed his firearms qualification and asked to leave the range in 2008.

Pictured far left... LTC Michael Stephens from Whitlocks office. Full uniform, duty belt with gun and taser and a Whitlock provided CVPI fully geared up with a lighting package in LEO colors. He is not a LEO at all, he's a civilian; impersonating on the streets of Louisville driving around with Whitlock using powers under Whitlock's "supervision".

If you look at any of Whitlock's citations, on many-many of them the complaining witness is Stephens.

While I am not a fan of this fellow, let me remind everyone that he is an elected official and because of that is a member of the law enforcement community. As with any officer involved in a critical incident I always hope for the best. I wasn't there, I don't know the facts f the case and will leave that to our PIU and KSP to sort out. My thoughts are for with his family and children who will ask him the same questions our children ask of us.

Again, I am not defending him, just trying to serve as a gentle reminder.

Guys I really do think that Whitlock, and his 'staff' must be mentally retarded. I don't mean to stereotype or to make fun of mentally challenged people, but just look at them! You can see that they are not 'right' by their appearance!

These idiots need to be prosecuted for impersonating an officer! From what I understand, the Constable position is in the KRS, so it's there, can't do anything until the law is changed. BUT, the KRS says he must have approval to appoint 'Deputies', which we know he does NOT have!!

Hey guys, how many people are on the street in patrol with all these details? I know everyone is riding at or below miniums. Why is this not ever addressed. An officer is going to get hurt because of this and the reason will be because we have their backup working the breeders cup, u of l game, half marathon, hike and bike, or any of the other 8 million details we have.

I begged media folks several times to dig into why all these civillian cars are all around town with red and blue lights..... especially during big construction projects..... tons of civillian cars including ones with Indiana license plates with red and blue lights.... I even brought it up to the FOP in years past because illegal wanna be and illegal civillian cars with red and blue lights are like scaps crossing a picket line taking off duty jobs away from US.....but our FOP is weak in this state....

I emailed both Mayor Fischer and County Judge Executive Matthews. I asked each of them if they or their office has 'Approved' Whitlock to deputize others. Per KRS, this is the only way he has authority to do so.

If they both answer 'no', my next call will be to the Commonwelath's Attorneys Office to ask for prosecution, then to the media outlets to inform them of the Police Impersonators in our midst. I will continue until something is done!

I'm retired now (from LMPD) so I'll 'stir the pot'. I have no worry of political/career fallout!

Here is the reply from Judge Executive Matthews:

I did receive a request from the Constable earlier this year to approve up to five Deputy Constables but that request was denied. I did not feel that additional Constables would be in the best interest of the community at that time nor was the Constable given any authority to act on this matter.

Likewise, I have not issued any requests to the Constables or duties to be performed. The Metro Council is charged with the authority to regulate sirens and lights on various governmental vehicles and I believe they have acted on the Constable's use in the past.

I just saw a video of another Constable involved shooting involving Stepehs and Whitaker. I wanted to pull it and put it on YouTube, but there is a crime being committed here and I don't want to deal with police by re-posting it.

This could have been fatal! I see several crimes being committed in this video. I have no more comment. DISTURBING!

I STRONGLY URGE EVERYONE who is reading and commenting on this site to go one step further, and send Jefferson County Judge Executive Bryan Matthews an email, demanding that these 'Deputies' be dealt with! His email is:

He has clearly stated that his office DID NOT approve of Whitlock deputizing anyone, and in fact told him NO. Given that Whitlock has no authority to deputize any person, his 'deputies' are Impersonating Police Officers! They are conducting law enforcement operations under the guise of Jefferson County Government with no consequences! Yet Judge Matthews has clearly allowed Whitlock to disregard a Judges order.

Judge Matthews has stated that Whitlock's deputies have NO authority whatsoever, So why is NOTHING being done about it?!

We can talk about this all day long, post pictures and videos, etc...but unless we put pressure on the powers that be- and keep it up- nothing will happen!

I read in one of his many comments to the media that his was advised by Walmart security that she had stolen something and that his "RAN" after her in the parking lot........ REALLY!!!!!!!

This doesn't look too good for this guy. I'm a Constable in TN and I'll be the first to tell the citizens of Louisville that most Constable's do not act in this manner nor do they have the criminal history that David Whitlock has. Do we have some bad officers throughout the state? YES, of course. Just like every profession, there are going to be bad apples. In our county we have two retired military officers who serve as constable and a retired Detroit Police officer who is also serving. I personally have a degree in Justice and Safety and have worked with the Govt. and the state. At the end of the day we have limits that should be set. For example, I'm not experienced in patrol or testing for DUI therefore I don't perform those duties as a constable. I would be a hinderance to the law rather than an assett. I work in areas that I have experience in and leave the patrolling of the the streets to actual patrolmen. Why some Constables in want to act like patrolman is beyond me. The fact is you run your own office, you don't have to patrol. I wish the best for everyone involved in this incident and I hope it doesn't affect those officers in small counties and smaller districts that do this job as a help to their community and truly enjoy being of service to the public. I just hope this sheds a light on what boundries one should consider when serving in this office.

There seems to be a great deal of venom on this one. I have no intention of debating whether or not State Law recognizes Constables as Law Enforcment officers, because it clearly does. However, no one has demonstrated to me the need for a Law Enforcement Officer to escalate a misdemeanor shoplifing to a level where deadly force could even be considered. The fact is Mr. Whitlock had a duty to treat this event for what it appeared or was reported to be...a shoplifting. If he was unable to get the alleged shoplifter to stop, he should have recorded a description of the person and the vehicle and pass it to responding police officer's for further action. As any trained Law Enforcment Officer will tell you, deadly force is only authorized in the most extreme circumstances...shoplifting just does not seem to reach to that level

Officials Call For Constable's Impeachment

PSU??? What's the deal here? Is this going to be another on of your year-long investigations?

Is Whitlock going to get 'tabled' like Chavous, etc...because his family has money and political ties?

First ,there is no need for constables in Jefferson County. Let's say the position is done away with tomorrow..are there any negatives to that? None!

Secondly, I find it funny that city politicians want to do something now but never wanted to do anything in the past. I believe someone stated early on that Councilman "I will do anything Jerry tells me to" Henderson supported Whitlock in the past. I find it strange that we complain on here about the improper use of emergency equipment, when in fact LMPD violates state law regularly. 1) Blue and Red Lights on a wrecker? (City Impound) They are specifically listed as public safety vehicles, like those that escort oversized loads so what we do is completely against KRS. And allowing Escorts both Code 3 and Code 2(No Longer allowable by law) for none law enforcement purposes. The KRS 189.940 Section 5 A,B, and C address this clearly. So escorts of U of L football team buses and any time and most certainly when out of the city is not allowed by law. Nor is escorting the officials from the football game Code 3 to the airport.

Remember what we learned in school and Emergency must exist to go code 3.

According to anonymous sources the Council is preparing a resolution to ask the State House to impeach troubled Constable David Whitlock. As many of you know by now by reading previous stories here David Whitlock, Whitlock has been a continuous source of trouble for citizens of Jefferson County and has his own questionable past.

District 12 Rep Rick Blackwell will be the sponsor, and co sponsors will be District 16 Rep Kelly Downard and District 6 Rep David James.

Additionally, I am being told the first of two ordinances curtailing the duties of the Constable are forthcoming this week. It is an ordinance that would prevent the Constable's employees, or volunteers from possessing any badge, or any official uniform including ones that mimic LMPD, and the Sheriff's office.

Sponsored by District 6 Councilman David James, and co sponsored by District 16 Councilman Kelly Downard, and District 12 Councilman Rick Blackwell, it will be presented this week.

So a lady shoplifts at Wal-Mart, and "Constable" David Whitlock is in the store. He is notified of the crime, and approaches the woman who is outside in her car. She runs over his foot, and so he fires a bullet into her arm and hand.

You have got to be f-ing kidding me.

First of all, for those who are wondering – what is a constable?

The office of Constable dates from Medieval England. Your Constable is an elected public official. The Constable is one of the only two remaining elected peace officers in the world. In Kentucky, the position of Constable was established in the 1850 Constitution. The present Constitution requires the election of one constable in each justice of the peace (known as magistrate) district.

Constables are Peace Officers with broad powers of arrest and authority to serve court processes. The Constable has the authority to enforce both the Traffic Code and the Criminal Code of Kentucky. They may execute warrants, summonses, subpoenas, attachments, notes, rules and orders of the court in all criminal, penal and civil cases (KRS 70.350). The Kentucky Constitution, Section 106, Constables will possess the same qualification as the sheriffs and may exercise jurisdiction in any part of the county. (OAG 62-115 and 40-776)

In summary, a douchebag. A sort of State Endorsed "Dawg The Bounty Hunter" for idiots like Whitlock who need to pack heat – even when shopping for Tostino's pizza at Wally World.

The sad part about this is that the shot fired injured the driver who was "accused" of shoplifting, but did she really? What if you were accused of shoplifting, and some douche came to your car wanting to confront you about it – handled it very aggressively (as we know this guy did) and then you end up getting shot?

What if a kid got shot in the mix up? I can understand a hostage situation, serial killer, or a rapist who has been at large for months. However, a SHOPLIFTER does not warrant a bullet being fired.

Steps To Handle Situation Appropriately:

1. If you are really gun handy, shoot the tires. However, I don't think guns were necessary here.

2. Get the license plate number.

3. FOLLOW HER IN YOUR OWN CAR.

4. Call 911, or get backup – you are not John Wayne.

Write to David Whitlock and tell him what a douchebag he is, and ask for his resignation! We do not need hot heads pulling out guns and shooting people for "shoplifting" (without evidence) around good clean community members.
