Louisville, Ky. (WHAS11) - A Louisville Metro Police officer is facing a 30-day suspension after failing to report an accident he had while on duty.

Chief White sent Officer Ashley Kendall a letter saying he should have reported a July 2009 accident when he struck a pole at the Jefferson County Youth Center.

Kendall has six previous disciplinary actions against him.

In addition to the 30-day suspension, Kendall was removed indefinitely from the take-home-car program.

A Louisville Metro Police officer has been suspended for 30 days after it was found he was involved in an accident while on duty and failed to report it.

Officer Ashley Kendall was suspended on May 4, found to have violated department policies of maintaining his patrol car, failing to file a vehicle damage report following an accident, and failing to follow orders of a superior.

In a letter sent to Kendall by Police Chief Robert White, he was told he should have reported the accident he was in on July 7, 2009, when Kendall struck a post at the Jefferson County Youth Center.

The suspension letter also says Kendall did not keep his patrol car clean, failed to clean up his vehicle when ordered to by a sergeant, and failed to notify the owner of an unoccupied vehicle he'd damaged.

Kendall has six previous disciplinary actions against him, including one in 2009 that involved failing to report damage to his vehicle.

In addition to the 30-day suspension, Kendall has been removed indefinitely from the department's take-home car program, in which officers can drive their patrol cars while off duty.

Suspensions may be appealed to the Police Merit Board. Kendall has not filed an appeal with the board.

Why is he just now getting a suspension from 2009? This incident is two years old! What happened to the other violations that occurred at Highland Middle School? I guess they swept those under the rug....they will not be forgotten!!

Not sure why we are sitting on this SB at the hospital, he is still thieving oxygen from the righteous. Apparently Nostra-Bassler-Damus-Merlin-Lionhearted-Ace Boon Coon was not on scene. He would have pulled out a can of 'THUG B GONE', blinked, and yo yo deejay daddy dope woulda been dust.

A Louisville Metro Police detective fired for tipping off a suspect in a drug investigation was given his job back on Tuesday by the Police Merit Board.

Ronald Russ was fired in December after Chief Robert White determined he had violated the department's policies on truthfulness and keeping police business confidential.

Russ, who was a narcotics detective at the time, told former Assistant Commonwealth's Attorney Matt Conway he was under investigation by police. When asked whether he told Conway about the investigation, Russ initially lied to investigators before finally telling the truth.

After a daylong hearing on Tuesday, the board, made up of five citizens and two police officers who hear officer disciplinary appeals, voted 3-2 to reinstate Russ and give him a 30-day unpaid suspension for the violations.

Police officers Austin Boone and John Keeling and board member David Hatfield voted in favor of the suspension. The board's chairman, the Rev. Alex Moses, and member Allison Grant voted against overturning Russ' dismissal.

Russ showed visible relief at the verdict following an emotional day of testimony in which he broke down several times on the witness stand.

"We're pretty happy he got his job back," said his attorney, David Leightty.

William Warner, the attorney representing the police department, said he will have to confer with the police chief before determining whether the department will appeal the board's decision to Jefferson Circuit Court, as is its right.

During his testimony on Tuesday, Russ at times wiped away tears and his voice cracked as he told the board he did not know what possessed him to issue the warning to Conway as they walked together briefly in a hallway at the Hall of Justice.

"I've run that through my mind a thousand times, over and over, and I do not know why I said that to Matt Conway," Russ said.

He said he and Conway had been sitting in a court office together, though not there on cases involving one another. When Russ got up to leave, Conway happened to be walking out at the same time, Russ said.

As the two reached the hall, Russ said he turned to Conway and told him there was an investigation against him. Russ said he told Conway that if he was using or selling drugs, he should stop before he got caught.

"I knew I'd made a big mistake the minute I walked away from Matt Conway," he testified.

At the time of his termination, Russ had served more than 19 years as a police officer, about six months shy of being eligible to collect his pension.

Conway, the younger brother of Kentucky Attorney General Jack Conway, resigned from his position on April 29. No reason was given for his resignation. Commonwealth's Attorney David Stengel has declined to talk about his departure.

Conway's personnel file, obtained under the Kentucky Open Records law, indicated he had been disciplined by Stengel. Conway had been told his job performance needed to improve, and he must submit to "random or unannounced drug tests."

During Tuesday's daylong hearing before the merit board, several references were made to discipline handed out by White against Scott Wilson, who also investigated Conway after a tip came in that he was involved in drug activity in 2008. Wilson was a narcotics detective but has since been transferred.

Wilson, who showed Conway the complaint against him and waited two days to conduct a consent search of his home, was given a written reprimand for his handling of the case. White said he had intended to fire Wilson, but after giving him a polygraph test, determined he never intended to harm the case against Conway.

Instead, White said Wilson believed the allegations against Conway were motivated by a domestic dispute and had no merit.

In Russ' situation, White said the 2009 investigation into Conway primarily was being handled by Russ' partner, Chauncey Carthan, and Russ should not have had contact with Conway while the case was open.

White's decision to fire Russ also was based in part by the fact that when he was asked if he had talked to Conway, Russ initially lied to police department public integrity investigators.

But Leightty said Russ told the truth about what he had done before he left the interview room.

Russ told the board he was scared of the consequences of his mistake.

"I was scared to get in big trouble," Russ said.
