A judge has ruled that a defense attorney cannot bring up a Louisville police officer's lengthy disciplinary record in an effort to impeach his testimony in an upcoming drug trial.

Assistant Public Defender Chastity Beyl had argued that Metro Police Officer Charles Moore's testimony about drugs he allegedly found on her client, Steven Lamont Curtis, should be suppressed, in part because Moore's credibility is suspect as a result of his disciplinary record - particularly several instances of dishonesty.

The Jefferson Commonwealth's Attorney's Office hadn't planned to call Moore as a witness, but Beyl had indicated she wanted to have the officer testify and would question him about his more than 800-page internal police file, which includes being suspended from the force seven times, reprimanded on another eight occasions and being the subject of four criminal investigations. Moore was never charged.

On March 7, Jefferson Circuit Judge Barry Willett ruled that since prosecutors have elected to not call Moore as a witness, instead relying on the testimony of another officer who was present during Curtis' arrest on March 11, 2008, it would not be appropriate to allow the defense to question Moore about his disciplinary record.

Willett did rule, however, that the defense could call Moore to the stand to discuss the arrest of Curtis. Willett also did not suppress the search and seizure of Curtis, who had an active felony arrest warrant.

Beyl said Monday that she was unsure if she will call Moore to the stand to testify about the arrest. Curtis is scheduled to stand trial in September on charges of possession of a controlled substance, tampering with physical evidence, disorderly conduct and being a persistent felon.

Moore is working in the second division as a district resource officer.
