But there shouldn't be a difference which is what I am trying to say. I could care less about this guys personal life, it isn't any of anyones business but his and whoever else is involved. People shouldn't be punished any more or any less for chance events that they have no additional control over.

Why should there be a different penalty? If your weapon goes off, you should be charged the same if it hits someone or not.
