Honestly... using department equipment to violate someone's privacy?
The issue for the courts and agency is not if his wife was or was not cheating on him, or if he was or was not justified to ask the question: the issue is why did he use his police authorities and equipment to invade another person's privacy without a warrant or probable cause, and for his own personal gain and/or non-professional law enforcement purposes.
If his wife's fidelity is the case, as much as I can sympathize for the man, his actions are like that of former Officer Chris Dison: He is accused of using department (tax payer) equipment for personal reasons.
