DUI is a shall arrest.... as long as the offender isn't driving a motor vehicle. :)
KRS 189.520 Operating vehicle not a motor vehicle while under influence of intoxicants or substance which may impair driving ability prohibited -- Presumptions concerning intoxication.
(2) "No peace officer or State Police officer shall fail to enforce rigidly this section."
So, according to the law, DUI is a "shall arrest" in the case of operating a vehicle that is not a motor vehicle. For some reason this language is not found in 189A (Operating Motor Vehicle). So DUI on a bicycle is a "shall arrest" (with a penalty of $35 for any officer who doesn't "rigidly enforce" the law, while DUI in a car is apparently not? Leave it to law makers to put jacked up stuff like that into the KRS.
