Louisville pays family $150,000 in death of Tasered man

March 5th, 2010 @ 10:02AM (14 years ago)

Yet another WTF? The story basically says it all. We the taxpayers of Louisville have once again been corn-holed by someone unwilling to prosecute or in this case re-try a case simply because they think the cost of trying the case will be greater than the outcome. BULL CRAP!

First off the Commonwealth's Attorney's Office is handling the case. What is the cost other than salaries and fees for a few expert witnesses? We don't have to spend any other time investigating. So , instead we are going to enrich the family of a crazed drug user that couldn't have given a tinker's damn about him when he was alive.

What's next releasing prisoners to save money? Oh yeah, the other main Douchebag Brashear is planning on doing that too.

There are consequences for criminal activity. If you commit a crime you should go to jail. If the Police tell you to stop, then compliance is in order. Failure to do so will be at your own risk. Further acts of violence against the Officers may result in you being sprayed, tasered or even shot.

QUIT PAYING THE FAMILIES OF THESE CRIMINALS WHEN THE POLICE ARE FORCED TO USE DEADLY FORCE!

LMPD was issued the tasers as a knee-jerk reactions to McKenzie Mattingly's shooting of Michael Newby. Like, if the department had tasers then Mattingly would have been carrying one of them undercover as he bought crack from Newby. In the end Louisville Metro paid Newby's family $250K. Fast forward......the officers use these tasers as they are trained & get sued (no surprises there) And.....Louisville Metro pays out $150K to the family. Seriously, I could not make this stuff up if I wanted to.

I cannot imagine why this idiot Mayor who says we are broke continues to pay out ridiculous ammounts of money on frivolous and winnable lawsuits like this. Is this some appeasement effort to the West End? Take back my taser. Let me beat the son of a ***** with a real nightstick or hell I will just shoot them. Imagine Mr. Boles how many people would have been shot with the old 40 cal. if we didn't tase them first!

Today I learned or should I say I re-learned that this administration does not give a damn about the public or the Police. It is all about their image and money. There is no such thing as "doing what is right" or "doing what needs to be done" in order to get the job done as any of us would do and as most citizens would do.

This administration is a bunch of spineless cowards. They will throw one of us under the bus or stab us in the back quicker than you can blink.

If I ever get the opportunity to sue metro government I will. I obviously don't have to be right. I certainly don't have to be obeying the law and without a doubt I or my family will reap the rewards for my misdeeds.

I am sorry this douche-bag died. Not because I knew him or his family, but I am sorry because of the stress and heartache both of the Officers that had to deal with him underwent. I am sorry that this guys family didn't do anything for him while he was alive, like take out an MIW or get him some treatment for his cocaine addiction.

I am sorry that this douche-bag was in the middle of the street, naked, throwing his own feces at pedestrians and motorists while his family did nothing. Couldn't his family have just tackled him and held him until the police got there? Couldn't any of the witnesses that claimed the police used too much force have talked him down or held his hand? Why do the Police always have to be the ones that "didn't" do anything right?

Lastly, why hasn't anyone in our administration held a press conference to strongly back our Officers that followed policy, that did what they were trained to do and valiantly overcame? Robert White you need to defend your Officers and quit playing the roll of "Silent Bob"!!!!

Couple of points - why do you keep letting the media get away with misrepresenting what actually happened with Noles? He wasn't "posing a threat?" Everytime they say this, every member of the department should drop a real letter, in the mail, to the top editor, news director, etc. of the media outlet that reported it setting the record straight. It can be the same letter, but it needs to be sent in separate envelopes. SWAMP THEM WITH MAIL. Now that the case is over, the real story needs to be posted up in detail for the public to read - no soft-pedaling.

Also, someone at the department (I don't work for LMPD) - needs to follow up and find out exactly what the settlement said. 150K - is attorney's fees coming out of that, or is the attorney being paid separately? I can't recall if this is a federal or state case, if federal, normally the attorney's fees for this kind of case are paid out on top of the judgment - different from other civil cases. The FOP needs to make an Open Records request for it.

A total disapointment. Those officer's didnt ask for this guy to die, they were doing their job with protecting other citizens from this crazed person. The family probably dont even care he's dead, even more so now that they got a sum of the actual tax paying citizens money. I wonder if they got to pay taxes on the 150K.. lol.

I was a juror for this trial and what you're told is not all the facts. The video was a small grainy POS file, coincidentally with no audio. Supposedly that day/week whatever the case was, the camcorders that were installed in that batch of police cars were sent faulty mics. We (the jury) couldn't hear anything, but from what we seen most thought the police used excessive force. There were 3 police officers on sight, and Mr Noles was naked. It was around 2am so pedestrians and car traffic was at a minimum. The whole video, which was only around 3:30 minutes showed 2 cars passing with ease. The officers said Mr Noles was combative which we seen none of that in the video. At the point of first contact, the 3 officers were surrounding Mr Noles, in which he took a half step forward trying to not be touched by the police and at his back. At that point the officer felt threatened somehow and deployed his taser. Once deployed you see Mr Noles lock his body up, still in a standing position and be tasered again. After the tasering was over, you see the officers pick up Mr Noles from the road, in a limp status and be put in the back of a cruiser. The testimony of the cops said Mr Noles was still moving/fighting as they were putting him in the back of the cruiser.
