Because , like I said before, they punished him as if he were on duty. He was in a marked police car, in uniform, on his way to work, ready to respond to calls for service. Under those conditions he was expected to respond if neccessary and would have or could have been punished if he didnt or wouldnt have if the dept decided he should have. Do you think a citizen would really care if an officer was on duty or off if under the described circumstances an officer came upon an incident that needed police attention?Try explaining to someone how you are not on duty when you are in uniform, in a marked police car, on your way to work.

I see your point and agree that this could be what gets the cars yanked. I think that because of the written and , more importantly , the unwritten rules and expectations of officers and the previous actions of officers taking runs on their way in, I think from the publics point of view officers are on duty when they are in those police cars. I really will be surprised if a jury rules against that.
