I took it to mean the Posse Comitatus provisions that prohibit the U.S. military (or federalized Guard) from performing law enforcement functions. Under the Title 10 Insurrection Acts, they CAN perform such duties, but that hasn't happened since the King riots in 1992.
And no, Kentucky law does not provide for any criminal liability if someone refuses to help, read the statute - 70.060. You can ask, but you can't make anyone do it. What would you charge them with - the specific statute AND the specific penalty? There isn't anything that provides for criminal liability.
