Mattingly was a criminal charge, that's a different matter. How often is an officer charged criminally - it is quite rare. I was speaking of the civil LAWSUIT that is almost sure to follow a shooting. The city must provide a defense to the officer in a civil matter, unless they can show one of the factors that the statute permits, it's KRS 65.200 - .2006. Who is representing Mattingly in the civil case?

That's one reason why the city settles - because they can't play the defendants against each other - the officer's defense may implicate the city, and vice versa. So, they just settle.

First let me apologize ahead of time for any spelling mistakes. I am sure all the cops who read this post will understand. The most important reason (but not the only one) for remaining an FOP member is that you must be an active member to qualify for the FOP Legal Defense Plan, which only costs you $215 a year at my last check. In the unfortunate event of criminal charges being wrongfully brought against you for a job action while on-duty the Legal Defense Plan picks up the cost. The total costs for my criminal trial was $87,902.35. How many of you have that kind of pocket change lying around? I did not and the Plan paid for every penny of it. In such unfortunates times you will want the best attorney. Rightfully so, I chose Steve Shroering. However, you can choose from any attorney authorized by the plan and there are many in Louisville. By chance if the attorney that you desire is not authorized than all they have to do is submit a few forms and then they are on like Donkey Kong. In the administrative stuff I believe you can still pick whoever you want. I might be wrong about that???? I chose Mark Miller cause when it comes to the contract, employment laws, administrative stuff, etc there is no one better in my book. The total costs of my administrative stuff was $21,930.02 of which every penny was paid for by the plan. The grand total of my legal fees for just those two is $109,832.37 as of 10/31/05 cause I just called and checked it. Now the civil stuff.....If the metro government is being sued alongside of you because of a job action they can provide for your defense. That does not mean they will. In my case it is no big surprise that they chose to provide for my defense being five million dollars of their money was at stake. If they dropped me like a hot rock as they had done with all other things pertaining to me then the Legal Defense Plan would have picked up my defense. The county attorney defends the Metro Government in lawsuits. Because of an obvious conflict with me (can you say indictment) the Co. Atty. contracted out my defense to two top-notch attorneys. And that is where it got real funny. My defense in a 5 million dollar lawsuit is paid for by the Metro Government through the county attorney. Follow me, Follow me....The attorney who would have fought against me on behalf of the police department to keep me off the department also works for the county attorney. SO at one time you had the Metro Government paying for an attorney to keep me off the department by alleging that I made mistakes. On the other hand you have attorneys paid for by Metro Government defending me arguing that I made no mistakes cause 5 million is at stake. The money is coming out of the same pot at the same time to two totally different sides of the game. Where's the politics & irony in that?? Let me read the above post again to see why I decided to post in the first place....The city did dump me in some aspects but not in others (5 Million $$) I have been more than happy with all my legal representation and feel all of my attorneys are awesome, each in what they do! signed-Figured out who I am yet?
