Profanity Towards Police Ruled Protected

I certainly disagree with the ruling of the court. Disordrly conduct is disorderly conduct, however I do have a problem with the Indianpolis police. Recently I was in Indanapolis driving behind a marked police car and to the best of my knowledge I was driving within the speed limits, going no faster than the police officer. It was 0830 on a Sunday morning. The officer pulled into the emergency lane and got behind me and pulled me over. He told me that I was speeding and that he was going to cite me. After showing him my license, I showed him my Louisville Metro Police Lieutenants badge. In front of my 14 year old daghter he told me "I don't give a ********** if you are a Louisville Police lieutenant or not, I'm going to cite you for speeding." I replied that in my 31 years of being a police officer that I have never cited another officer. With that said, he told me that he wasn't going to cite me but he would follow me and if I went 1 mile over the speed limit he would arrest me. He asked for my supervisors name and said that he was going to report me to him. Since I was not on duty and not driving a police car I couldn't see how this mattered.. I was respectful to him and apoligized if I did anything wrong.for my daughters' sake. For you young officers out there you must realize that if we don't stick together and help each other out then we are alone, because all we have is each other. If I had been a civilian, that one traffiic stop would have left a sour taste in my mouth for all police officers. When you stop the public, don't be an ********** hole especially to you brother officers.

How much money did they spend dragging a DC charge against a Juvenile to the Supreme Court? I guarantee they had a public defender too. More taxpayers dollars poured down the drain so some scumbag lawyers can pump up their resumes with a Supreme Court case

That is, if the Supreme Court will hear the case.

This battle has been fought over and over. The 1st Amendment always wins. Officers need to get over themselves. If you can't handle profanity being tossed at you, you are in the wrong line of work. The sad part is Indiana has some great laws that we need here, like resisting law enforcement. The police tell you to do something ,like get out of the car and keep your hands in sight and you don't comply, off you go on a charge of resisting lawenforcement. Tell your buddy not to comply with a lawful order from an officer, off you go to jail for resisting law enforcement. We just need to find the right charge and write it up well and the bad guys don't have a chance.

This is exactly why police are not respected the way that they should be. Our justice system allows them to treat police officers like trash and receive no sort of punishment. Even though they were not charged with the crime they should have received a warning and a fine. This will show them that their behavior will not go un-noticed.

If I were really that worried about the new case law of other states, I'd be a lawyer. In the absence of any other charges, just cite them with Harassment until someone takes the law off the books. Citing them into court may waste enough of their time and money to make them think twice before cussing out the police the next time. Taking someone to jail for most misdemeanors is a waste of time anyhow.

The courts may have thier say but in the end he still went to jail and lost his freedom for as long as they may have kept him. And the officer probably got paid to go to court also! I'll still lock up anyone who treats me like that, always have, always will.

I wonder what would happen to those same individuals if they shouted profanities at the Indiana Court of Appeals???????? Would that be First Amendment rights or CONTEMPT OF COURT !!!!

Recently. my son was pulled over in the town of Lizton IN. After running a license check, they found out his license had been suspended because he had failed to pay a speeding ticket on time. My son called me to come to the scene. After arriving, I spoke to the officer (named Javie) and asked why my son's car (registered in my name) was being towed. He explained that it was the common procedure. Being frustrated, I said "I can't f**king believe this" as I was walking back toward my vehicle. At this point, the officer told me to "stop right there" and said "I was this close to being arrested" making the gesture with his fingers. When I asked why, his comment was for "profanity". I returned to my vehicle and the tow truck arrived some minutes later. I asked "Javie" if they used a "rotation" for calling for a towing service and was told "it was none of my business and that he made the decisions". The reason I asked the question was it appeared the tow truck driver provided some restitution (a twenty dollar bill) directly to the officer.

I walked up to the tow truck driver to ask the directions to where the vehicle was to be taken. At this point, "javie" got very agitated and told me "I had two seconds to get into my vehicle and leave the scene or I was going to be placed under arrrest for disorderly conduct".

I never once raised my voice to the officer and only used one profane word in the heat of the moment. I just wanted some questions answered from him and the towing service.

Please note that I never denied the charges on my son.

This individual is a police officer in a town of 900 people (deputy Marshall) and has a definite "power trip syndrome". I feel this type of attitude when dealing with the public is unneccessary, unprofessional, and inappropriate.

My best guess was he needed to impress the "ride along" passenger with him. I also don't understand why both of them searched my son's vehicle for any "contraband".

To finish, at best it seems based on a case of profiling that started with the initial stop. There were three individuals in the car: My son and his female friend (white) and the other male (African-American).

The next town over, "Pittsboro", recently terminated an officer for the same type of profiling situation.

My suggestion would be to avoid the "Lizton and Pittsboro" area as it is not the best place to visit.

I would file a complaint but I was told by a Hendricks County Sheriff deputy that it is a "one officer" town with no supervision. Any comments would be appreciated
