Well, she doesn't have standing to sue anyway, I assume she isn't the deceased's next of kin. And I don't think a lawsuit based upon a smile would work, and I know a lawsuit against the CJ wouldn't either, they've fought that battle before - and in that case, they printed the photo intentionally! As for smiling at the scene, I wonder if anyone caught the entire interview on tape? If so, how many times did SHE smile - or one of her cohorts in the background? I didn't see the footage, I don't watch
