Police chief's criticism casts doubt on Metro Council plan to restrict LMPD's use of force

It seems that only LMPD is being targeted. LMCOs are county-wide ordinances, replacing all Jefferson County ordinances ever since the city-county merger in January 2003. If this proposed ordinance is passed and signed into "law", how will this affect all of the other law enforcement agencies operating within the boundaries of Jefferson County? They need to be asking these questions to make sure that the metro council's ordinance proposal, if passed, isn't going to jeopardize their safety as well.

All of the suggested policy recommendations that were mentioned in this news article are already included in the department's SOP... this isn't new territory for our officers. The only reason why the Metro Council wants to incorporate these specific policies and procedures into a metro ordinance is so that they can have the legal power to enforce them with criminal penalties. Don't be fooled, you know they'll try if given the opportunity. If during an emergency situation an officer deemed it necessary and prudent to shoot at a moving vehicle or bypass the force continuum, do you actually think they're going to care about your specific reasons for taking the appropriate action? Hell no they won't care. If this metro ordinance becomes codified, they will use it as a way to file criminal charges against you. Even though it's just a local ordinance and not KRS, they will still try to enforce it to make an example out of you. The federal government pays its investigators 2 to 3 times more in salary to do generally easier jobs involving far less danger than LMPD pays detectives. An agent makes more than a major does to lock people up for fraud weekdays on dayshift, while a homicide detective gets paid about half to go after murderous street gang members at all hours of the night on weekends. It doesn't take a genius to figure out who'll get a lot more people applying or staying after they're hired. Pay LMPD that much and a lot of the problems will go away too.

The west end just keeps getting worse. There's absolutely no chance this group is ever going to challenge any armed criminal, especially not a street gang who'd serve them up for dinner to possums and raccoons until a garbageman called police a few days later. The Metro Council says they have to sign off on the new contract for it to be valid and supposedly most of them aren't going to agree to it. The County Attorney staff, in their usual incompetent style, agree with the metro council that they can veto the contract signed by the Mayor. Unfortunately for them, the law at KRS 67C. 414 is crystal clear that once it's signed by the Mayor it's a valid enforceable contract. There's no publication even required after it's signed and the Metro Council lacks standing to even file a suit regarding the contract, although any FOP member covered by the contract can sue for a contract violation. KRS says it is the exclusive method of doing a police contract, which pre-empts and nullifies any contradictory metro council ordinances.

Fischer and company love to sneak around and do things that don't make any sense just to see if they can get away with it, but they never needed an agreement with KSP to investigate LMPD shootings. KSP is the state-wide police and they don't need anyone's permission to investigate a crime by a law enforcement agency any more than the FBI does. They could even investigate FBI agents or anybody else if they shoot somebody in Kentucky. As could have been easily predicted, charges dropped and lawsuit filed. Even if some criminal points out somebody as a co-conspirator, if that's all you have, you don't have enough to immediately use force to get their ID. You may have enough reasonable suspicion to detain him until he tells you who he is. If he's not walking away, then there's no rush to put the cuffs on or transport him to get his prints run through the system.
