If they can prove beyond a reasonable doubt that he knew he was shooting at police and it resulted in her death, then he could be charged for her death too. To know the answer to that you'd have to know for sure that the officers did announce themselves and that he heard them announce it before they started busting in the door. That's the risk of no knocks. If he claims he was asleep and didn't hear them yelling, and only heard them busting in the door, then at least 1 jury member might get convinced of that.

Another question is whether the officers fired the shots as they claimed or if what they told investigators has any holes in the story. The officer who was shot didn't leave any blood inside the apartment according to the news. There were dozens of shell casings outside the apartment where an officer could not have possibly seen a clear target.

The investigators now have to prove they were where they claimed to be when they fired the shots, prove who fired what shot, which shots hit her and what shots may have been fired wildly in a reckless or wanton manner endangering the neighbors.

I'm not taking anyone's side. These are all things the investigators and prosecutor would have to look at to finish this investigation
