It's a desperate gimmick that isn't going to work. It might work if someone did something wrong one time if they had nothing in their record to indicate any problems and action was taken immediately to correct or stop the situation. They would have had to claim it at the start, not the end, of the lawsuit. A city can't offload blame when when an officer engages in misconduct for a long period of time and nobody took action to stop it until it was way too late.

I'm never surprised by the bad ideas coming out of O'Connell and his attorneys in civil suits. They should hire a good law firm to do that work for them. The quicker you offer a complainant a fair sum up front, the less likely they'll drag you through the courts. Making people wait and lawyers trying to play hardball after the fact makes the amounts go up.
