They're hoping to drag it out so Fischer can finish his term. The lawsuits will take years to work their way through the courts. If they were to admit that Fischer ordered stand-down after stand-down, they lied to the public about it, many people got hurt and many businesses destroyed, then it would be enough to convince the last few holdouts to remove Fischer from office.
The top problem they face is that removing Fischer be pointless without removing Hess, Schroeder, Chavous and all the others running things in May and June who haven't retired yet. There are many who need to be fired, but is there anyone better available to replace them?
This is a bit like having a dysfunctional army unit in a combat zone. There's only so much you can do until the bullets stop being fired. The Metro Council does a good job of offering criticisms but they rarely ever been able to put a workable answer into place despite objections from the Mayor. That's always been their problem. There's a lack of talent in Metro government that isn't going to be filled anytime soon.
