The other problem with that idea is that the bullets were fired by police at an unarmed individual. Unless the shooter was hiding behind her like a hostage take might do, there's no way you can convict him for that. This isn't the military. Police officers must have a clear target and justification for lethal force at all times. She got hit several times and the shooter got hit times. That's a bit of a problem.
