Her BAC combined with his excessive speed to product the collision. I'd say he's 75% at fault. He'd have gone to prison for at least a few years in Indiana, but Ricky Kelly would have gotten the death penalty in Indiana too. The last 2 or 3 people to murder police officers in Kentucky would have been behind bars at the time of their homicide if they'd committed their previous criminal acts in Indiana. This state is pathologically lenient because you have Republicans who won't spend money on prisons and Democrats who want every thug out of jail so they can vote Democrat.

I'll be retiring in Indiana.
