Very unlikely to be a death penalty case. It was not pre-meditated, and he did it in a horribly conceived way to escape the business. Save the death penalty for the pre-meditated guys. Give this guy life without parole and let DOJ's clients work their magic on him. Make him suffer, don't give him the easy way out.
