Sure, but he didn't REPORT it as the statute requires. Did he report that KSP violated the law in an official manner to one of the parties listed in the statute? That's the bottom line for this statute and I don't see any indication that he did. Best I can tell, the exculpatory information was discovered long after the actual conviction, and so far, no law specifically sys that an agency must report that to the defense. (Maybe it should, but it doesn't.)
Fortunately, by the way, Metro Louisville is considered a county, not a city, because the Ky Supreme Court recently ruled that cities aren't subject to the Whistleblower Act. (Which is interesting, because the 6th Circuit says they are ....)
