The story clearly spells out the guy and his family were disorderly (did he charge them all?) but be careful guys...many states are clarifying open carry does not itself equal disorderly conduct. And I know this is not the case here......just urging caution on future events as people may test the police. There was a law change in July.

Who gives a crap if he had a gun. It was holstered. Eat your sandwich, listen to your radio for dispatched runs, mind your business, quit trying to create police work when it isn't necessary, and collect your paycheck. Nobody in the front office or the court house is going to back the officer on this one. Family will file a lawsuit and collect a settlement.

This Officer was 1000000% wrong. it's legal to open carry in KY. For god sake you can open carry in the State Capital. Now if Arby's asked him to leave, then fine Criminal Trespass and eat ur roast beef... We hire kids with no life expierence and no idea about the laws..

You are obviously one who stands up for your rights. I strongly urge you to not take any plea deals. Go to trial and win. Any jury would rule in your favor. DO NOT stipulate probable cause and get yourself a good civil attorney. If a settlement is discussed, do not settle for a penny less than $75,000.

As it was once told to me by a knowledgeable source: it's only illegal to conceal the weapon on your person or in your vehicle without a permit, not to simply possess it.

Several states are slapping law enforcement really hard for stuff like this. "Concealed carry" laws only apply to CONCEALING the weapon, not possessing it, unless specific exceptions are named.

And how does the "disorderly conduct" charge hold up? Did the restaurant employees or other customers complain about the gun? Or was the suspect told by an employee to leave because of it and he refused? If the answer to both questions is "no," then I don't see how the disorderly conduct charge can be applied. Even if the officer was knowledgeable about the store policy, as a police officer you are only sworn to enforce state laws and local ordinances, not the policies of private corporations.

This guy probably went to every small town in Kentucky trying to get someone to "bite" on his open display of a weapon in order to get paid. He couldn't get any nibbles until he came to the booming metropolis.

As the story is written, Sgt. Lainhart is absolutely wrong. He could politely ask that he cover it up, but his demand was legally unfounded and in violation of clearly established state law.

Open Carry walk in downtown Louisville

Open Carry Walk in Downtown Louisville starts at 8AM Saturday morning. We are having the Open Carry Walk to show our support for Mr. Helms who was arrested for refusing to submit to an illegal order by a LMPD officer. We will be celebrating our Second Amendment rights during our walk.

We are going to start at 6th and Cedar streets and proceed north until we get to West Market St. We will then turn east on West Market Street and proceed to 5th Street where we will turn south for one block until we get back to West Jefferson St. we will then proceed west on West Jefferson Street until we reach 8th Street. We will turn north on 8th street and proceed to East Main Street. We will turn East on east Main Street and proceed down to 4th Street. We will turn south on 4th street and proceed until we get to West Muhammad Ali Blvd and then we will turn west and proceed to 6th street. We will then turn north on 6th street and proceed to our starting point at Cedar. This particular route will take us past the Louisville Metro department of corrections and the Louisville Metro Criminal Justice Center. This route will then takes us past the Louisville City Hall building on 6th Street. We will pass Vincenzo's Italian Restaurant on West Market street and then we will pass by the City Hall building on West Jefferson. We will pass by the Louisville Police department on West Jefferson Street. We will come upon the Louisville Slugger Museum and Factory then the Louisville Science center. As we continue we will pass by the Kentucky Museum of Arts and Crafts as we head down East Main street. We will pass by the Kentucky Center and the Kentucky Center for the performing arts the PNC bank Building and National City tower. As we go south on 4th street, we will pass Aegon tower on the way to 4th Street Live where we will pass under the old Galleria. We will head west when we get to the Starks building passing by the Seelbach hotel. We will then turn north on 6th street to conclude the organized walk at our starting point at the corner of 6th and Cedar streets. I have virtually walked this route on google streets and we will pass by some nice buildings and some historical locations.

I applaud the chief for making some changes because he is concerned about increased crime or violent crime...but one solution would be not having Officer/Detectives/Sgt./Lts. working 25,000 man hours on traffic/security details taking officers from patrolling neighborhoods, catching drug dealers, doing computer forensics, polygraphs, working on rapes, murders, robberies, fraud, DV, crimes against children, missing persons, assaults, burglary, car thefts, street robberies etc... It truly is OUT OF CONTROL with traffic/security details!!!

The "Viper Unit" for the name of the new unit is a bad idea. I know it's an acronym and it sounds really cool, but it also has a sinister sound to it. The minute something controversial happens, the media focus will be on the name of the unit which has images of something attacking or preying on something. Same thing with LAPD's "Rampart" Unit in the 90's. "Rampart" was a play on words for 'rampant' which means out of control.

Also, for the love of God, change the name of PSU to 'Internal Affairs Bureau' (sounds more professional).
