"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. "
So, let us examine the freedom of speech clause of the First Amendment. The free-speech guarantee operates only as a barrier to censorship by government officials or agents of the government.
Did you see the part where it acts as a barrier to the government, not a privately held business. With the agency of the government, this means that 'they' may take no action to inhibit or limit the lawful use of the expression of speech in an any format, with the exceptions when an individual may be on duty, and then fall under the rules of their employment.
With the decisions to not pay on-call pay to officers, none of us are never truly on call and thus the standards of the agency can't be used in our private lives.
To do so would most likely bring in an argument for a violation of 42 USC 1983.
