Contract says if your working as acting chief then get paid as acting chief. Sorry boss but if you don't want to pay then don't ask them to be night chief do away with it.

A former recruit with Louisville Metro Police was in Jefferson Circuit Court on Monday, facing felony charges on allegations that he stole evidence from the department's property room this year.

Troy L. Hilpp, who was fired Sept. 1, is also accused of making "misrepresentations" to three different doctors to obtain prescription drugs, according to court records.

He is charged with tampering with physical evidence, theft and obtaining a controlled substance by fraud.

Assistant Jefferson Commonwealth's Attorney's Elizabeth Jones Brown said during the hearing Monday that she has made a plea offer to Hilpp, which would include either a year in prison or a three-year prison sentence probated for five years.

Hilpp's attorney, John Berry, said they were reviewing the offer and a judge set another hearing date for January.

If convicted on the current charges, Hilpp could face a 10-year prison sentence.

On Aug. 23, according to court records, Hilpp removed a Play Station 3, a printer and an amplifier from the department's property room, where he was working, and placed them in a garbage bin to steal them.

A week later, Hilpp used the same method to steal two digital cameras, according to court records. The cameras were recovered from his home.

In an interview with police, Hilpp admitted that he had made a "terrible mistake."

Sgt. Robert Biven said Hilpp started in November 2009 as a police recruit and was placed on administrative duty in February because of a medical condition and then put in the property room in March.

Biven said an internal review was done and police don't believe "any other evidence was compromised as a result of this individual."

Prosecutors also accuse Hilpp of visiting three different doctors between Aug. 25 and Aug. 30 to fill four prescriptions of hydrocodone and oxycodone "based on misrepresentations to the doctors."
