What more to the story could there be? They had a warrant, they had a matrix, and if the story is even halfway correct, they had no business doing a "shock and awe" on the house. The Court does not like this blatant attempt to say - the paper (matrix) made me do it! Common sense, folks, common sense, that is what they expect from a SWAT commander. (And who did make the decision? Cobaugh or someone else?) Apparently the prosecutor didn't think much of the case against the son, you don't dismiss a case like that because you don't want to make the children testify. You dismiss it because you have a bad case! I doubt they are stellar citizens, but mom (and this is mom's case, son has nothing to do with this part of it) will get money or will go to trial. And a jury will find against the City, I guarantee, if this story is even half true. One more time, this is a case involving MOM - not son.

Don't even think there will be a change of venue - why would there be? This is a federal case, far worse cases have been tried in their home venue. We didn't get a change of venue for Mattingly and that was a lot more volatile. It will be tried, if it is tried, in Louisville, but the jury can come from anywhere in the surrounding area. But you tell a rural homeowner that his wooden fence means his home is fortified and you are going to lose them immediately. Doesn't really matter what they knew about son, he didn't live there, and he wasn't even there at the time, which they would have known with just a little bit of work. Lord - LMPD is its own worst enemy in these cases!
