Who cares if he fired a shot or not. If he has a gun in his possession, and he's not following the officer's orders, then that is more than enough legal reason to shoot him.
Don't take my word for it, just look up some of the case law on the subject. Go look up what state and federal law say in this area, or ask any prosecutor that has experience in homicide cases. If you have a gun and you're in any way acting hostile or resistive towards the police, you're about to be a dead man. It doesn't matter if Evan fired a shot, the shooting will easily be ruled justified whether he fired a shot of not (given the other factors present).
I'm sorry your friend is dead, but sometimes when you make a bad enough mistake it turns out to be fatal for you.
