Why would we want to give him the benefit of the doubt? Did you mean to say innocent until proven guilty? He did violate policy. They did a pbt on scene which blew way over the limit so he did violate a policy. Also you have to have evidence to indict. He was indicted stupid. There is no benefit of the doubt.
